4 Govt Officials Charged Over Ksh 291 Million Scandal

Four individuals, Simon Kachapin Kodomuk, Mary Cheptur Ngoriakes, Mathew Pkanan Arusio, and Francis Pkemoi Tikol, have been charged before the Eldoret Law Courts with conspiracy to commit an economic crime, contrary to Section 47A(3), as read with Section 48 of the Anti-Corruption and Economic Crimes Act.

It is alleged that on diverse dates between 8th February 2018 and 11th October 2018, within West Pokot County, the accused persons, being public officers employed by the West Pokot County Government, jointly conspired to commit an economic crime, namely the fraudulent acquisition of public funds amounting to Ksh. 291,063,050.00 through irregular withdrawals from the West Pokot County Bursary, Education Development & Infrastructure Fund.

The accused face a total of 27 counts of economic crimes, including fraudulent acquisition of public property, abuse of office, wilful failure to comply with applicable procedures and guidelines relating to the management of public funds, wilful failure to comply with procurement laws, making false documents, false accounting by a public officer, and issuing bad cheques.

The prosecution submitted that the accused persons, in their capacities as the Chief Officer for Education and the Director for Bursary, respectively, breached their fiduciary duty, thereby defrauding the county of substantial amounts of money earmarked for educational development.

The 2nd to 4th accused pleaded not guilty, while the 1st accused did not appear in court, and summons were issued for 1st October, 2024. The court reserved its ruling on the bond application for 1st October 2024.

Notorious Violent Robbery Victims Arrested

Two suspects linked to a string of violent robberies in Ngata area- Nakuru County have been arrested following an Intelligence led and meticulously coordinated operation by a team of detectives drawn from Riftvalley RCIO’s office, DCI Rongai and DCI Nakuru.

The apprehended individuals; Collins Masira Michira and Cornelius Audi Odhiambo were arrested while onboard a motor vehicle registration number KDC 439M at Mercy Njeri location in Rongai Sub County.

A search in their getaway vehicle led to recovery of items believed to have been stolen from the victims including four mobile phones and a variety of adult’s & children’s clothes and shoes.

In addition to the stolen items, the vigilant detectives uncovered several crude weapons including a knife, a machete, a crowbar and heavy-duty cutting pliers all suspected to have been used to break into buildings and to inflict injuries during the robberies.

The suspects are currently detained at Menengai Police Station pending arraignment.

Dr. Joseph Birundu Mogendi was among the few scholars who were making fourth academic walk across the graduation stage.

Mogendi received received a Master’s degree in Public Administration, adding to his impressive academic portfolio that already includes a Bachelor of Science degree from Jomo Kenyatta University of Agriculture and Technology (JKUAT), an MSc from Ghent University, and a PhD in Applied Biological Sciences from Ghent University, Belgium.

His academic journey reflects his dedication to bridging the gap between science, technology, innovation, and public sector reforms. His work, which focuses on enhancing the uptake of research findings and innovations in the public sector, is seen as a roadmap for improving governance and service delivery in Kenya’s devolved systems.

6 More Testify Against Police Officer Charged With Shooting and Killing Class 8 Boy During Protests

This week, six witnesses testified in the murder trial of police officer Dancan Ndiema, also known as Champe.

Ndiema was charged with the tragic killing of 13-year-old Yasin Moyo, who was shot while standing on the balcony of his family’s apartment in Huruma during the COVID-19 lockdown, a time marked by widespread fear and uncertainty.

The Office of the Director of Public Prosecutions (ODPP) presented six witnesses from September 17th to 19th 2024.

These include Yasin’s two sisters, his mother, father, and a neighbour. The prosecution alleges that officer Ndiema fired the fatal shot in the Kiamaiko area of Huruma, Nairobi County.

Witnesses provided emotional and poignant testimony, recalling the heartbreaking moment when Yasin cried out to his mother, saying he had been shot.

Their accounts also detailed the family’s desperate efforts to save Yasin’s life a tragedy that has left a lasting impact on everyone who knew the deceased. The emotional weight of these testimonies was palpable in the courtroom.

The proceedings were interrupted several times to allow the family members to compose themselves, as their grief overwhelmed those present. This case is being prosecuted by Ms. Sarah Ogweno and Ms. Dela Wilbey.

Further hearings are scheduled for May 29th, July 8th, 15th, and 24th, 2025, as the quest for justice for Yasin continues, and support remains steadfast for his grieving family. At the time of his death, Yasin was a Standard Eight student at Ndururuno Primary School.

Like many other students, he was at home after schools closed due to the COVID-19 pandemic. The accused is currently out on a Sh1 million cash bail, with the condition that he does not interfere with witnesses scheduled to testify against him.

Petition filed over irregularities committed at Kenya Railways

The Kenya Railways managing director is on spot over irregular extension of his term in office as the corporation Managing Director by the board of directors.

This was revealed by Bunge la Mwananchi president Francis Awino who has petitioned the courts.

In his petition, Awino stated that the term of Mainga was extended from 2023 by three years after he was acting in the role.

“There has been illegalities and irregularities committed by the responded. KRC board quietly extended his term by three years after his term in office ended in 2023.” Awino said in his petition.

The petitioner stated that the illegal extension of the term of the MD has caused ripple effects to the corporation adding that the board was compromised to see his extension.

He noted that there was a hitted exchange between the board and him where a member of the board was injured.

In his petition, Awino added that there has been acts of corruption overseen by the MD that has led to embezzlement of funds.

“While unlawfully and irregularly in office, the respondent has overseen and executed documents on behalf of KRC and has engaged in gross acts of corruption and embezzlement of public funds.” Awino said.

Further the MD has been accused of leasing of huge chunks of the Corporation to private developers without following the right and set procedure.

“The respondent has leased a parcel of land approximately 37.86 hectares to private developers. He also allocated a piece along Kampala road in Industrial area to a private developer sparking uproar from neighbouring industries ” The petition stated.

Despite expressing their concerns, Mainga has been accused of failing to favour the affected companies and has instead continued with structure building.

According to the petitioner, development is illegal as there was no environment assessment report given.

This comes as an audit report indicated that the KRC MD has been abusive of his post.

The petition is expected to be filed in court at the end of this week with the Kenya Railways MD as the first respondent.

Serial Killer in Murder of 4 Women Charged

Ezekiel Sakwa Mwangi, also known as Kwame, a 19-year-old suspect linked to several heinous crimes in Rongai sub-county, Nakuru County, has been arraigned before the Nakuru High Court and charged with four counts of murder.

Mwangi’s arrest on August 18, 2024, set off a chain of legal proceedings, beginning with his arraignment at the Molo Law Courts the following day.

The Molo Magistrate Court granted detectives a 30-day window to delve deeper into the case, a task that was soon taken over by homicide detectives from the DCI headquarters.

The investigation uncovered a gruesome timeline of events spanning from July to August 2024. Mwangi is suspected to have sexually assaulted and murdered four women, including a minor.

The horror began on July 13, 2024, when five-year-old Alice Ayuma was found dead in a maize plantation in the Mwangaza area, her body bearing the marks of a brutal assault with a rungu.

The violence continued on August 5, 2024, when Virginia Njeri Mwangi met a similar fate at the Menengai prayer cave.

The following day, in Kalyet village, 34-year-old Florence Mueni Mwalimu was struck down, and her body discarded in a bush.

The killing spree culminated on August 7, 2024, along the railway line at Baraka Estate, where Vellah Moraa Mogambi was attacked and fatally wounded. When presented before court, Mwangi pleaded not guilty to all charges and sought release on bond, a request that was firmly opposed by the ODPP.

The case is set for mention on October 15, 2024.

President William Ruto on Wednesday urged the National Police Service (NPS) and the Judiciary to collaborate for the benefit of the Kenyan people. Speaking during the launch of reforms for the Police and Kenya Prisons in Nairobi, Ruto addressed the ongoing tension between Acting Inspector General of Police Gilbert Masengeli and Chief Justice Martha Koome, stressing that conflicts between these two critical institutions could significantly hinder service delivery.

Ruto acknowledged that while both the NPS and the Judiciary are independent entities, it is essential for them to work in harmony. He warned that continued discord between the two bodies could affect their ability to serve the public effectively, undermining efforts to strengthen law enforcement and the justice system in Kenya.

“I am acutely aware that the National Police Service is independent, and so is the Judiciary, but ultimately, we have one master—the people of Kenya,” Ruto stated. He emphasized that no government office was established for personal gains, and thus, all public servants must prioritize the nation’s welfare over individual interests.

The president called for unity and selflessness, reminding both the police and the judiciary of their shared responsibility to serve the Kenyan people. “I want to ask all of us to work together selflessly for the good of the nation. Social and political activist Mercy Tarus, famed for exposing the Finland Education programme scandal where hundreds lost their money in Uasin Gishu is topping trends after the latest outburst.

In a firely tweet on Wednesday morning, Mercy went ham on who we can all tell to be the latest political sensation Morara Kebaso.

According to the post, she accused Morara of derailing from his initial plan of carrying out civic education to Kenyans to starting political ambitions.

Mercy accused Morara of camping in her DMs looking for advice only for him to go out there shining with the ideas to the public.

Notorious Robbery With Violence Suspects Arrested

DCI detectives drawn from Coast Regional Headquarters have arrested two individuals believed to be behind a spate of robberies while wielding pangas and using a motorcycle as their mode of transport.

Mohammed Ibrahim Shaban, 22 years and Abdulaziz Ali Ogutu, 19 years were smoked out of their hide out at Utange village from where they were planning their next attack.

The duo is believed to be behind a series of panga attacks including a violent robbery resulting in a fatal incident on July 18, 2024.

They are also linked to three separate robberies on September 14, 2024, in Majengo, Makupa and Tononoka.

A search of their residence resulted to recovery of several items including 1 panga, 3 knives, 2 assorted mobile phones, two back packs, an ID card belonging to Yusuf Amani Yusuf among other items.

The Director of Criminal Investigations has extended his sincere appreciation to members of the public for their unwavering support in the fight against crime and sends a stern warning to would-be criminals that no resources will be spared in the fight against their unlawful ways.

In a political landscape where trust and loyalty are paramount, the Nyahururu Declaration—an unprecedented decision by certain MPs from Mt. Kenya and the diaspora to elect Cabinet Secretary Kithure Kindiki as their link to the President—has raised eyebrows.

This move, while seemingly benign, is a subtle yet sharp blow, not only to Majority Leader Kimani Ichung’wah but also to CS Kithure Kindiki.

First, it is important to clarify that this is not a personal attack on either Ichung’wah or Kindiki.

Their political acumen is undeniable. In fact, they have been role models for many, including myself, as we ventured into elective politics.

However, when a man is thrust into the political pitch as the ball, we must play the game—may the best team win, but woe unto the ball (Kindiki).

The Nyahururu Declaration has caused more harm than good, especially to Ichung’wah. A man entrusted to lead government business has, knowingly or unknowingly, through his MP followers, delegated his mandate to an appointee of the President.

How can leaders who are directly elected by such a vast electorate delegate their representative power to a non-elected Cabinet Secretary, especially when their own colleague, Ichung’wah, meets the President daily?

This declaration inadvertently amounts to a vote of no confidence in Ichung’wah and those who endorsed it. Proverbs 12:15 states, “The way of a fool is right in his own eyes, but a wise man listens to advice.”

The Nyahururu Declaration suggests that these MPs are not listening to wisdom or the electorate (ground) but are acting out of misguided self-interest. Moreover, this decision is perplexing given the accessibility of President William Ruto, a leader well known for his open-door policy.

Why would MPs feel the need to appoint a middleman to reach a President who is more approachable than any we’ve seen in recent history? By appointing Kindiki as the “link,” are these MPs not implying that Ichung’wah is incompetent in representing them effectively, or worse, that the President himself is unresponsive?

I am particularly disappointed with the legislators from Kiambu who were part of this declaration. Kiambu, a county with 1.25 million votes, has effectively handed over its political power to an unelected man from a county with just 231,000 votes.

If my Kiambu MPs truly felt the need for an intermediary, why not suggest former CS Moses Kuria, a man from Kiambu who has been appointed as an advisor to the President? But they couldn’t do that because there is a deeper, more sinister undertone to this declaration—one that should not be ignored.

The MPs who endorsed this decision are the same ones who voted ‘Yes’ to the controversial Finance Bill, a bill that sparked nationwide uproar. Are they now concealing their true intentions—intentions aimed at dethroning Deputy President Rigathi Gachagua as the de facto uniting figure for Mt. Kenya?

Rigathi’s popularity and call for unity among the Mlima people have caused anxiety, prompting these MPs to hatch a plan to divide Mt. Kenya into smaller regions—a move that would shift the balance of power in Mt. Kenya politics and dilute Rigathi’s influence.

It’s hypocritical to accuse the Deputy President of discussing the unity of the mountain and ‘kingpinship’ while at the same time holding conferences and workshops to declare the same unity of the mountain.

These same MPs have gone ahead to install Kindiki as a kingpin. In essence, they agree with the DP that unity of the mountain is paramount and that it requires a kingpin—it only seems to be a problem when the DP is the one saying it.

Meanwhile, Kindiki should take note of the experience of Kiharu MP Ndindi Nyoro. The same Nyahururu declarants had once proposed Nyoro as the next kingpin, only to drop him along the way. Now, he is dusting himself off as he attempts to regroup.

This is a lesson that Kindiki should keep in mind—political loyalty can be fleeting, and those who are celebrated today may find themselves abandoned tomorrow.

I’m not Mutahi Ngunyi, nor am I a fortune teller, but it appears that these MPs are being used in a larger scheme, perhaps even to attempt the impeachment of the Deputy President—not because he has broken any laws, but, as US Representative Al Green once said about Donald Trump, “I’m concerned if we don’t impeach this president, he will get re-elected.”

Could this be what’s on their minds? Country music legend Elvis Presley once said, “Truth is like the sun. You can shut it out for a time, but it ain’t going away.” The actions of these MPs are a prelude to something much larger, and their true intentions will soon come to light.

Meanwhile, Deputy President Rigathi Gachagua remains the de facto leader of Mt. Kenya, as well as the principal assistant to the President, pursuant to the will of over 7 million voters.

Kindiki, on the other hand, remains an appointee of the presidency—assuming Gen Z won’t make a comeback. In conclusion, the Nyahururu Declaration was more than just a symbolic gesture.

It was a calculated move that undermines the very fabric of representative democracy. Ichung’wah and Kindiki have scored an own goal, while Gachagua continues to enjoy unwavering support—not only in Mt. Kenya but across the country.

It is time for the people of Mt. Kenya to reflect on the actions of their leaders. The vision for Mt. Kenya’s political future must not be lost amidst the chaos of self-serving political maneuvers.”
