Through a notice issued to the public, the commission listed the vacancies in different ministries.

Woman Who Posed as Senior Court Official Charged With Sh 172K Fraud

A woman has been charged for posing as a senior court official and defrauding a businesswoman some Sh172,000 on the grounds that she was in a position to help her release her relative who had been charged and convicted contrary to the law.

The kin to the complainant had been jailed at Kibera Law Courts. The complainants are at great sorrow since they say they trusted the lady who even wanted over Sh 350,000.

Nancy Wanjiru Muturi was charged before Kibera Chief Magistrate Ann Mwangi where she denied the charges.

The court heard that on diverse dates between January 5, 2023 and February 18, 2023, in Upper Hill Area within Nairobi County obtained the said amount from Teresia Mugure Wachuka contrary to the law.

In court, the prosecution requested that the accused person be granted tougher bond terms.

The magistrate released him on Sh 50,000 cash bail with a surety of the same amount.

The case will be mentioned next week for a pre-trial and further directions.

DP Gachagua Pledges Unwavering Fight Against Drugs and Illicit Brew

Deputy President Rigathi Gachagua has vowed that the national government will continue its relentless battle against drugs and illicit brews, emphasizing that the fight will not falter.

Gachagua made the statement during a visit to Githunguri, where he offered his condolences to Kiambu Senator Karungo wa Thang’wa and the Mitahato Community following the loss of Thang’wa’s brother, Martean Wainaina Thang’wa, and sister-in-law, Penninah Wanjiru.

During his visit, Gachagua highlighted the importance of ongoing efforts to combat the illegal trade.

Deputy President Rigathi Gachagua has called on Mount Kenya leaders to set aside succession politics and unite in the pursuit of development for the region.

Speaking on Wednesday in Kiambu during the burial of two relatives of Kiambu Senator Karungo Thangwa, Gachagua emphasized the importance of working together to fulfill the promises made during the campaign.

“This is the time for unity of purpose. We must stop fighting each other and focus on delivering for our people,” Gachagua stated.

Wetang’ula Sued for Defaulting on Payment for Dog Training and Supply

Speaker of the National Assembly Moses Wetangula is embroiled in a legal dispute over an alleged unpaid debt of Ksh. 281,000.

The lawsuit, filed in the Small Claims Court by Isokat Bethwel, centers on an agreement for the supply of two German Shepherd dogs and related training services.

Wetangula, who did not appear at the Milimani Small Claims Court and did not send a representative, has been summoned to court on October 4, 2024.

According to court documents, Bethwel was contracted by Wetangula to provide two male German Shepherd dogs, training services, and various dog-related supplies including food, grooming items, and training equipment

Bethwel claims that the total cost for the services and supplies amounted to Ksh. 348,100. While an initial payment of Ksh. 100,000 was made, Bethwel alleges that Wetangula has not paid the remaining balance of Ksh. 248,100.

Bethwel also claims the dispute has caused him significant psychological distress and potential financial losses.

“I waited for the payment of the remaining balance of Kenya Shilling Two Hundred and Forty-Eight Thousand, One Hundred (Kshs 248,100) but all was in vain. I had taken a soft loan from a friend, who ended up auctioning my properties in the village due to my inability to pay, which was caused by Wetangula’s delayed payment,” Bethwel said.

The complaint further alleges that Wetangula has refused to honor the agreement, with Bethwel asserting that all attempts to recover the outstanding amount have been met with resistance.

“I tried reaching out to the Respondent to recover the said balance but the Respondent rudely and adamantly informed me that he would not pay me the remaining balance,” reads the court papers.

“I waited for the payment of the remaining balance of Kenya Shilling Two Hundred and Forty-Eight Thousand, One Hundred (Kshs 248,100) but all was in vain,I had taken a soft loan from a friend and he eded up auctioning my properties in the village due to failure to pay and tius was occasioned by Wetangula delayed payment ,” Bethwel stated.

Bethwel reported the matter to Karen Police Station under OB number OB7A1N1N19/21 and has been unable to access Wetangula despite several attempts to visit his home.

Wetangula in a Whatsapp message had arlier told the media that he wants a refund of his downpayment for the farmer to take back his dogs.

“I have told that gentleman to bring back my deposit of Sh100, 000 and collect his grossly overpriced dogs. Tell him to deliver the payment to my home manager and take his dogs. I will not charge him for feeding and caring for them for the period they have been in my custody” Wetangula said adding that; “Besides, I may contemplate ln against him for defamation and nuisance”.

The case is set to continue with a court date scheduled for October 4, 2024, where Wetangula is expected to address the claims made against him.

Notorious Lawyer Thomas Otieno Ngoe And Nicholas Otieno Ndolo’s Sh134 Million Gold Fraud Case to Continue in September

The hearing of a high-profile case involving Sh134 million gold fraud has been postponed until September.

Principal Magistrate Rose Ndombi has set the date for the hearing on the 24th of September, 2024, marking the next chapter in a legal battle that has captured significant attention due to the involvement of an advocate and the substantial amount of money involved.

The case revolves around two accused individuals: Nicholas Otieno Ndolo, a businessman, and Thomas Otieno Ngoe, an advocate. The duo is accused of defrauding a foreigner, Seth Adam Bernstein, of USD 1 million, which is approximately Sh134 million.

The transaction, according to the charge sheet, was allegedly conducted under the pretense of facilitating the shipment of gold from Kenya to Dubai.

The allegations against Ndolo and Ngoe stem from an incident that took place on the 11th of February, 2024, in Nairobi.

The charge sheet details that the two men obtained the money from Bernstein under the guise that their company, DSI Mining and Minerals Company Limited, was capable of paying customs duties for 3,000 kilograms of gold that was to be exported from Kenya to Dubai. However, the prosecution argues that this was merely a ruse to defraud the unsuspecting foreigner of his money.

Adding to the complexity of the case, Ndolo faces an additional charge of forging a mineral export permit. The permit, bearing Reference No.EAC/22/92709141708/2022 and dated 16th May 2022, was allegedly fabricated with the intent to deceive and further facilitate the fraudulent scheme.

The prosecution claims that this fake document was part of the elaborate scam that convinced Bernstein to part with such a substantial amount of money.

Both Ndolo and Ngoe have strongly denied the charges brought against them. During a previous court appearance, they pleaded not guilty to all counts and were subsequently released on a cash bail of Sh1 million each.

Their release on bail has been met with mixed reactions, with some questioning the adequacy of the bail amount given the gravity of the charges.

The case has garnered significant public interest, not only due to the large sum of money involved but also because of the involvement of a legal professional.

Cases of gold fraud are not new in Kenya, but this particular case stands out due to the high-profile nature of the individuals involved and the international element, with a foreigner being the alleged victim.

The postponement of the hearing to September gives the defense and prosecution more time to prepare their cases. For the prosecution, the challenge lies in proving beyond a reasonable doubt that the accused were indeed involved in a scheme to defraud Bernstein.

Visoi MCA Faces Backlash Over Disruptive Sand Dumping at Salgaa Parking Lot

Visoi Ward MCA, Madam Hellen Mengek, is under intense criticism after her decision to dump construction sand at the busy Salgaa parking lot caused significant disruptions for the local community.

The once orderly parking area has been turned into a chaotic mess, leading to blocked access and considerable frustration among drivers and business owners.

MKU founded by Simon Gicharu to pay Professor Moni Wekesa Sh6.8 million for unfair termination

Mount Kenya University (MKU) has been ordered to pay Professor Moni Wekesa Sh6.8 million for unfairly terminating his employment.

Professor Wekesa, who is currently teaching at Daystar University, had sued MKU for wrongful dismissal, initially seeking Sh46,172,728 in damages for various constitutional rights violations.

The Employment and Labour Relations Court (ELC) awarded him Sh6,855,170, which includes nine months’ salary, damages for constitutional violations, and severance pay.

MKU subsequently appealed the decision and requested a temporary stay on the implementation of the ruling.

The university argued that if it won the appeal, it might struggle to recover the funds from Professor Wekesa. However, Justice Rika denied the stay request.

Former MKU students free to collect certificates after Sh80m fee waiver

“This petition has been pending since 2016, and the Court has addressed it comprehensively and fairly. There is no reason to delay Professor Wekesa’s long-awaited remedy. Any errors in the remedy granted can be corrected on appeal without causing prejudice to MKU,” Justice Rika stated.

MKU contended that the compensation awarded was excessively high and not supported by the law.

They also claimed that the trial court erred by awarding remedies under both the Employment Act and the Constitution.

In response, Justice Rika noted that MKU had not cited any legal authority indicating that statutory remedies should exclude constitutional remedies.

He emphasized that the court’s decision was based on the gravity of the violations against Professor Wekesa and the evidence presented.

Justice Rika remarked that MKU’s argument did not persuade him, stating, “The Court reduced the initial claim by nearly Sh40 million and awarded a modest sum. There is no basis for the claim that statutory remedies alone should suffice, nor that granting constitutional remedies was erroneous.”

The judge concluded that refusing to stay the execution of the payment order would not prejudice MKU’s appeal.

City businessman Viral Jitendra Amritlal Pattni has been charged with Sh 2.3 million fraud after failing to deliver jewellery to a client.

Viral Jitendra Amritlal Pattni is accused of obtaining Sh 2,375,000 from Shaitsa Khamisa Abdul Latif by falsely pretending that he was in a position to supply her with two Tazanite diamond rings, a Tazanite bungle on 18kt yellow gold, Tazanite earrings on gold and two Morganites earrings rings 8.2cts each, a fact he knew to be false.

Pattni is alleged to have committed the offense on diverse dates between 17th January and 20th February 2023, at Parklands area in Nairobi County, with intent to defraud.

The accused is also facing two other counts of issuing bad cheques.

The court heard Pattni issued a cheque of Sh 475,000 and Sh 75,000 in favor of Latif knowing the said account had insufficient funds.

Pattni allegedly committed the offences on 3rd March 2023 and 9th March 2023 respectively.

He denied the charges before Chief Magistrate Susan Shitubi.

The prosecution opposed his release on bail on grounds that he has absconded court for the past seven months.

The court heard the accused was brought to court under a warrant of arrest.

Pattni will be remanded at Industrial Area Remand prison for nine days pending the ruling on his bail opposition.

Man Who Duped Foreigner Claiming He Would Inspect 200 Kgs of Gold Charged

A man alleged to be part of a gold scam syndicate in the city has been charged with conspiring to steal from a foreigner by falsely claiming he could facilitate the inspection of 200 kgs of gold at JKIA.

Obadiah Kipkemoi Langat, alias Richard, was accused of conspiring to steal Ksh 309,000 from Azimagli Serge Amani between August 2 and 6, 2024.

He allegedly misled Amani into believing he could arrange the inspection of 200 kgs of gold detained at Jomo Kenyatta International Airport, a claim he knew to be false.

Langat denied the charges before Magistrate Ndombi and was released on Sh 150,000 cash bail.
