Petition filed over irregularities committed at Kenya Railways

The Kenya Railways managing director is on spot over irregular extension of his term in office as the corporation Managing Director by the board of directors.

This was revealed by Bunge la Mwananchi president Francis Awino who has petitioned the courts.

In his petition, Awino stated that the term of Mainga was extended from 2023 by three years after he was acting in the role.

“There has been illegalities and irregularities committed by the responded. KRC board quietly extended his term by three years after his term in office ended in 2023.” Awino said in his petition.

The petitioner stated that the illegal extension of the term of the MD has caused ripple effects to the corporation adding that the board was compromised to see his extension.

He noted that there was a hitted exchange between the board and him where a member of the board was injured.

In his petition, Awino added that there has been acts of corruption overseen by the MD that has led to embezzlement of funds.

“While unlawfully and irregularly in office, the respondent has overseen and executed documents on behalf of KRC and has engaged in gross acts of corruption and embezzlement of public funds.” Awino said.

Further the MD has been accused of leasing of huge chunks of the Corporation to private developers without following the right and set procedure.

“The respondent has leased a parcel of land approximately 37.86 hectares to private developers. He also allocated a piece along Kampala road in Industrial area to a private developer sparking uproar from neighbouring industries ” The petition stated.

Despite expressing their concerns, Mainga has been accused of failing to favour the affected companies and has instead continued with structure building.

According to the petitioner, development is illegal as there was no environment assessment report given.

This comes as an audit report indicated that the KRC MD has been abusive of his post.

The petition is expected to be filed in court at the end of this week with the Kenya Railways MD as the first respondent.
