Duncan Muiruri, Managing Director of Cledun Realtors, has explained the three main types of title deeds in Kenya, highlighting the differences between freehold, leasehold, and sectional titles, and advising property owners to understand their rights and obligations under each.
Muiruri said that a freehold title deed, also known as an Absolute Title Deed, grants permanent ownership of land with no time limit. He explained that freehold owners enjoy maximum rights over their property and that this type of title is most commonly used for private residential or agricultural land.
On leasehold title deeds, Muiruri noted that ownership is limited to a set period, often 99 years. He said that while leaseholders have the right to use the land for the duration of the lease, ultimate ownership remains with the original owner, usually the government.
He added that leaseholders are typically required to pay annual rent or land rates and that leasehold properties are common in urban areas or on government-leased land.
Regarding sectional title deeds, Muiruri explained that they apply to individual units within larger buildings, such as apartments or townhouses. He said that while owners have full rights over their specific units, they also share ownership of common areas with other residents.
He noted that sectional titles are used for properties with shared facilities, allowing multiple owners to coexist within a single development.
Muiruri emphasized the importance of understanding the type of title one holds, as each carries different rights, responsibilities, and restrictions.
