KCAA Found in Contempt as Court Orders Payment of Sh2.2 Million to Former Employee after Kurauka’s suit

The Kenya Civil Aviation Authority (KCAA) has been found in blatant disregard of a court judgment after failing to settle a Sh2.2 million award to a former employee, Vivian Nyakerario Ongwae.

In a ruling delivered at the Employment and Labour Relations Court in Nairobi, Justice Jacob Gakeri allowed an application by Ongwae seeking enforcement of the decree issued in her favour. The court faulted KCAA for failing to comply with the judgment without any justification.

The Judgement after lawyer Henry Kurauka through the complsinant filled a case in court accuding the KCAA of ignoring a court order.

Additionally, the judge issued a garnishee order absolute directing that a total of Sh2,221,104 be paid to Ongwae from KCAA’s account held at Kenya Commercial Bank.

The amount arises from a prior judgment in which Ongwae through Kurauka successfully challenged her dismissal from the aviation authority.

“The Respondent is guilty of blatant disregard of the court judgment and decree without any justification,” the ruling reads in part.

In addition to the principal sum, the court ordered KCAA to bear the costs of the application, further compounding the financial burden on the state agency.

Kurauka argued that KCAA’s continued delay in settling the award amounted to defiance of a lawful court order.

The court agreed, paving the way for direct recovery of the funds through the garnishee process.

The orders were issued on April 22, 2026, and signed by the Deputy Registrar, warning that failure to comply could attract penal consequences.

The ruling now places pressure on KCAA to immediately settle the dues or face further legal sanctions, including possible enforcement measures against its accounts.
