The High Court sitting in Nairobi has suspended the decision by Labour Cabinet Secretary Alfred Mutua that purported to have lifted the Suspension of the General Secretary of the Kenya Union of Commercial and Allied Workers after city lawyer Henry Kurauka’s intervention.
The Judgement was issued by High Court Justice Moureen Onyango of the Employment and Labour relations court.
“ That Pending hearing of the application inter partes the application is granted in terms of prayer (c) thereof . The letter dated June 30, 2025 from the Cabinet Secretary Ministry of Social Protection Ref.ML/LD/LAB/162 tittle “ LIFTING OF SUSPENSION ‘’ addressed to the registrar of Trade Unions purporting to overturn the decision of the registrar of Trade Union is hereby suspended pending inter partes hearing of the application,” Justice Onyango ruled.
The Judge directed the Judgement be served to the Cabinet Secretaries.
The Judgement came after the Kenya Union of Commercial and Allied Workers through City Lawyer Henry Kurauka filed an application in court under the certificate of urgency protesting.
In the application, Lawyer Kurauka told the court that the CS decision to suspend the suspension of Mr. Bonface Mutie Kavuvi was illegal and unconstitutional.
Kurauka told the court to intervene and protect the rights of the Kenya Union of Commercial and Allied Workers on the ground that it the action of the Cs was unacceptable.
“Action of the by the Cabinet Secretary of Labour and Social Protection is ultra vires and unlawful because the powers and the mandate of the to lift the suspension vests in the honorable court hereof,” he told the court.
Additionally, Kurauka told the court that the Cs is bound by article 10(102) which provides for the binding national values and principals of governance of the rule of law, democracy, human dignity, equity, social justice, good governance, transparency and accountability.
Kurauka told the court that on May 30 , 2025 by the registrar of trade unions effected new changes suspending the respondent as the General Secretary of the claimant and confirming Andrew Kinyua M’mukiri as the acting General Secretary of the Union hereof.
This is not the only case that Lawyer Henry Kurauka has successfully been involved.
In recent days , Kurauka has been championing for the rights of Miraa Farmers, has also fought for the rights of individuals who have been unfairly sacked from their jobs among other prominent cases.
