No more issuance development Permits city hall told amid a serious legal battle

Environment and Land Court in Nairobi has extended the order stopping Nairobi City County from issuing development permission in Parklands Local Area pending hearing of an application by Parklands Residents Association.

High Court Judge Ann Omollo also directed that the Petition filed by the resident be heard by a 3-judge bench ‘given the weighty legal and factual issues raised in the Petition’.

Parklands residents have sued the County Govt, Patrick Mbogo (CECM) Patrick Analo (Urban Planning) and Godfrey Akumala (Ag. County Secretary) accusing them of failing to appoint members to the Physical and Land Use Consultative Forum since August 2019 as required by law, and also refusing to initiate processes for preparation and publication of County and Local Physical and Land Use Development Plans, leading to so-called developers constructing illegal high-rise buildings and other structures in the Area.

The residents have also raised several issues on breach and violation of their fundamental rights, and on activities deleterious to the environment, and wants the court to make declaratory orders that all development and construction works undertaken in the Area since August 2019 is illegal and unconstitutional.
